Motion for Declaratory Relief

Overview

The Motion for Declaratory Relief which is reproduced below requested the Court / Judge Peter I. Breen to determine :

  1. Whether Petitioners are beneficiaries and remaindermen of the LFT.
  2. Whether Petitioners have a right to due and timely notice with regards to the administration and accounting under the LFT in accordance with this Court’s Order of August 13, 1982 and the laws of the State of Nevada.
  3. Whether Petitioners have a right to a true, correct and complete accounting of the LFT and to review and obtain, if necessary, copies of supporting documents, books, papers and records regarding the LFT pursuant to this Court’s Order of August 13, 1982 and the laws of the State of Nevada.
  4. Whether Petitioners have a right to restitution for breaches of legal and fiduciary duties, misaccountings, and wrongful conversion of LFT property.
  5. And Petitioners ask for such other relief regarding the rights and relationships of the parties as the Court deems just and proper.

Trustees: Opposed any determination by the Court.
